Terms of Service

These Terms explain the rules for using Viral View, including paid access, user-provided API keys, uploaded content, AI outputs, prohibited uses, third-party providers, and service limits.

1. Acceptance

These Terms of Service govern your access to and use of Viral View, operated by Jon Mac. By signing in, subscribing, uploading content, generating media, or using the app, you agree to these Terms and the Privacy Policy.

If you are using Viral View for a company, agency, client, or other organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Viral View is a paid creative workflow app for analyzing source videos, rewriting scripts, building character references, remaking frames, generating video clips, editing assets, adding overlays, and exporting ad-style media.

The service depends on third-party platforms, model providers, infrastructure providers, and APIs. Features may change, pause, or stop working if those providers change their rules, pricing, limits, availability, or safety systems.

3. Eligibility

You must be at least 18 years old to use Viral View. You may not use the app if applicable law bars you from using it or if your account has been suspended or terminated.

You are responsible for complying with the laws, platform rules, advertising rules, and intellectual property requirements that apply to your content, clients, products, and campaigns.

4. Account And Access

You sign in with the email address or Google account connected to your paid Viral View subscription, and must maintain access to that email account or Google account.

You are responsible for all activity under your account. Do not share your account, attempt to access another user account, bypass payment, bypass rate limits, or probe private routes, uploads, projects, sessions, or API keys.

Viral View may deny, suspend, or revoke access if paid access cannot be verified, if a subscription is cancelled or disputed, or if account activity creates security, abuse, legal, or operational risk.

5. Paid Subscription

Paid access is handled through FanBasis or another checkout provider shown at purchase. Subscription terms, payment method handling, renewals, taxes, cancellations, refunds, and disputes may be controlled by that provider and by the terms shown at checkout.

Access may be limited, paused, or removed if payment fails, a chargeback occurs, a subscription expires, or Viral View cannot confirm active entitlement.

6. User API Keys

Each user must provide and maintain their own Kie.ai API key. Viral View does not share a global Kie.ai API key across users.

Your Kie.ai API key is used to run AI requests you start inside Viral View. You are responsible for your Kie.ai account, provider charges, rate limits, model availability, and compliance with Kie.ai and underlying model-provider rules.

Do not submit someone else's API key or use Viral View to evade provider limits, moderation, billing, or safety systems.

7. Your Content

You keep ownership of the media, prompts, product information, scripts, project data, uploads, and outputs you provide or generate, subject to these Terms, third-party provider terms, and applicable law.

You grant Viral View the limited rights needed to host, store, copy, transmit, process, transform, generate, edit, display, troubleshoot, secure, and export your content to provide the service.

You are responsible for ensuring you have all rights, permissions, licenses, consents, releases, and legal bases needed to upload source material, use product assets, generate new content, and publish or distribute outputs.

8. AI Outputs And Review

AI outputs can be inaccurate, inconsistent, unsafe, infringing, incomplete, visually flawed, or unsuitable for a specific platform, ad account, audience, claim, or product category.

You are responsible for reviewing, editing, clearing, fact-checking, and approving outputs before using them publicly or commercially.

Viral View does not guarantee that generated media will be unique, free of defects, accepted by ad platforms, free of rights claims, or fit for any particular business result.

9. Prohibited Uses

You may not use Viral View to create, upload, generate, edit, distribute, or promote unlawful, abusive, deceptive, exploitative, infringing, harassing, hateful, sexualized-minor, non-consensual intimate, violent extremist, malware, spam, credential theft, or platform-abuse content.

You may not impersonate another person without permission, mislead people about synthetic media where disclosure is required, violate publicity or privacy rights, scrape the service, attack the service, reverse engineer private APIs, bypass security controls, or interfere with other users.

You may not upload confidential, sensitive, biometric, medical, financial, government-identification, or proprietary material unless you have authority to process it in Viral View and through the relevant third-party providers.

10. Third-Party Services

Viral View uses third-party services including optional Google authentication, email delivery infrastructure, FanBasis, Cloudflare, Kie.ai, and the AI models or processors made available through Kie.ai.

Those services are not controlled by Viral View. Their terms, privacy policies, pricing, rate limits, safety systems, outages, and decisions may affect your ability to use features or access outputs.

Links to third-party services, product pages, source pages, or checkout pages are provided for convenience and do not mean Viral View controls or endorses those services.

11. Usage Limits And Operational Controls

Viral View may apply file type restrictions, file size restrictions, abuse controls, paid-access checks, and content safety checks.

We may block, throttle, delete, quarantine, or refuse content or requests that create legal, security, provider, cost, platform, or abuse risk.

12. Availability And Changes

Viral View is provided as an evolving product. Features, prompts, workflows, providers, models, limits, pricing, storage behavior, and exports may change.

We work to keep the app available and projects recoverable, but no online service, AI provider, or media-processing system can guarantee uninterrupted access or perfect preservation of every asset.

13. Feedback

If you send ideas, suggestions, bug reports, prompts, workflows, or other feedback, you grant Viral View permission to use that feedback without restriction or compensation, while you keep any rights you already had in your own underlying content.

14. Privacy And Security

Your use of Viral View is also governed by the Privacy Policy. You are responsible for protecting your email account, Google account if used, Kie.ai account, downloaded files, exported media, and any credentials connected to your workflow.

Report suspected security issues through the support channel inside Viral View. Do not publicly disclose vulnerabilities before Viral View has had a reasonable chance to investigate and fix them.

15. Suspension And Termination

You may stop using Viral View at any time. Viral View may suspend or terminate access if you violate these Terms, create risk, lose paid entitlement, misuse providers, infringe rights, or use the service in a way that may harm other users, Viral View, or third parties.

After termination, you may lose access to projects, uploads, generated media, and exports. Some records may be retained as described in the Privacy Policy.

16. Disclaimers

Viral View is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Viral View does not promise that the service will be uninterrupted, secure, error-free, profitable, accepted by ad platforms, or compatible with every provider, file, browser, device, or workflow.

17. Limitation Of Liability

To the maximum extent permitted by law, Viral View and Jon Mac will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, content, goodwill, revenue, business opportunities, or provider credits.

To the maximum extent permitted by law, the total liability of Viral View and Jon Mac for any claim related to the service will not exceed the amount you paid for Viral View in the three months before the event giving rise to the claim.

18. Indemnity

You agree to defend, indemnify, and hold harmless Viral View and Jon Mac from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of outputs, your violation of these Terms, your violation of law, or your violation of third-party rights.

19. Governing Law And Disputes

These Terms are governed by the laws of British Columbia and the laws of Canada that apply there, unless applicable consumer law requires otherwise.

Before starting a formal claim, you agree to contact Viral View through the support channel and try to resolve the issue informally. If informal resolution fails, disputes will be handled in the courts located in British Columbia, unless applicable law requires another forum.

20. Changes To These Terms

Viral View may update these Terms as the app, providers, pricing, laws, or business needs change. The updated date above shows when these Terms were last changed.

Your continued use of Viral View after updated Terms are posted means you accept the updated Terms.
